How dating before your divorce is final can be a problem

It may have been the most difficult conversation to have with a spouse, but deciding to get divorced does not suddenly make an individual single and ready to mingle. Although many people in Marietta likely start dating before their divorces are ultimately finalized, dating and signing up for an online dating profile could cause more problems than many may think. What would you do, for example, if you came across a soon-to-be ex's online profile and he or she doesn't mention that he or she has children?

When it comes to child custody, Georgia law requires that child custody decisions be based on the best interest of the child. There are many different factors that a judge may look at, and sometimes it just comes down to with which parent the judge believes the child will do better. Because these kinds of decisions are decidedly subjective, no parent who wants custody of his or her children should give a judge any reason to choose the other parent.

Many child custody attorneys would likely suggest that divorcing parents not start dating before a divorce and child custody agreement is finalized. In addition to the implication that the parent is ready to move on before his or her marriage is technically over, single parents must walk a careful line about how to include their children in the new relationship.

If the parent is too eager to include children in the new relationship, a judge may think that the exposure to a new parental figure is premature and confusing for the child. On the other hand, if the parent fails to inform his or her new partner of his or her children, it could seem like the parent does not take his or her responsibilities to the children seriously. If this information is on an online profile, it can be brought into court as evidence.

Child custody can be extremely difficult to navigate alone and any parent looking to preserve a relationship with his or her child should work closely with a child custody attorney to protect his or her rights to his or her children.
