There Are Multiple Types of Alimony

Alimony is not one size fits all. If the judge deems a spouse qualified to receive alimony payments, determinations will need to be made regarding the amount of the payments and how long they will need to be made.

There is a variety of alimony and spousal support plans, including:

  • Permanent alimony: This form of alimony is increasing rare, but may still be awarded in appropriate cases. Typically, permanent alimony would be granted to a spouse who has been married for decades and stayed home to raise children rather than obtaining an education and establishing a career outside of the home.
  • Transitional or rehabilitative alimony: This type of alimony is still relatively common after a divorce, particularly when one spouse has a significantly higher income than the other. These payments typically last a few months or years as one spouse transitions into their new life.

When determining whether there is a need for alimony, judges may look at other factors as well, including the presence of special needs children, physical or mental health issues of a spouse, or a great disparity in education level and earnings potential.
