What Is the Two-Year Rule? How Will It Affect Me?

Many people are confused and even frightened by the two-year rule. However, all the two-year rule says is that no one can file a modification for child support less than two years after his or her last successful attempt to modify child support.

There are two common myths or misconceptions with respect to the two-year rule:

  • Q: Can I file a modification for child support within two years of the divorce decree?
  • A: Yes, you can. In fact, you can file a modification for child support the day after the divorce decree is issued and you can be successful. Most successful modifications are filed because of a change in either spouse's income.
  • Q: Can I file a modification for child support within two years of my ex-spouse's filing a modification?
  • A: Yes, you can. It doesn't matter when or if your ex-spouse has filed for a modification. The only thing that can prevent you from filing a modification is if you yourself have filed one within the last two years.

In any situation, if either spouse fails to honor the terms of the divorce decree, the other spouse may file a contempt citation. However, the law frequently changes. For information about recent changes in the law, click here.
